  Former CJ’s loyalist removed as Judicial Services Commission Secretary

  Judicial Services Commission Secretary, P.W.D.C. Jayathileka, who is closely associated with former Chief Justice Sarath N. Silva, has been removed from his post with immediate effect. Chandra Jayathileka has been appointed as the Post and Telecommunications Ministry Secretary by the President.

Jayathileka was serving as a senior judge in the Court of Appeal when he was appointed as the Judicial Services Commission Secretary on a proposal made by the former chief justice seven years ago.

Jayathileka, who enjoyed similar benefits as a senior Court of Appeal judge when appointed as Judicial Services Commission Secretary, has now been appointed
  to a secondary level position.

The long standing conflict between Supreme Court judge Shiranee Bandaranayake and Jayathileka had also played a key role in the latter’s transfer. Bandaranayake had to resign from her membership in the Judicial Services Commission earlier following certain unanimous decisions taken by Jayathileka using powers vested with the Chief Justice, for his benefit.

The Chief Justice at the time acted in support of Jayathileka.

In this backdrop, the President decided to re-appoint Bandaranayake to the Judicial Services Commission.
The President decided to remove Jayathileka after members of the Judicial Services Commission informed him through the Presidential Secretary that Jayathileka would obstruct several inquiries the Commission headed by the newly appointed Chief Justice has decided to launch. The Judicial Services Commission has decided to inquire into 150 complaints received on judges representing different levels.

It is learnt that the Commission had failed to inquire into complaints received against judges loyal to the former Chief Justice. It is also learnt that some of the complaints received by the Commission against the judges are unbelievably serious in nature.

Inquiries have also not been conducted on complaints received against the Judicial Services Commission Secretary.

It is reliably learnt that the new members of the Judicial Services Commission are faced with difficulty due to the lack of proper record keeping by the Commission authorities for an extensive period of time. The reason for not keeping proper records has been attributed to a cover up by then officials at the Commission to hide the unlawful activities that had taken place.
